Ride at Your Own Risk | Safety First

By booking, reserving, boarding, or accepting a ride with The Golf Cart Girl-CLE, you acknowledge, understand, and agree to the terms below.

These terms apply to all riders, passengers, guests, private groups, event rides, tours, partner experiences, brewery tours, wine bar experiences, custom rides, and any other transportation or cart-based service provided by The Golf Cart Girl-CLE.

1. Assumption of Risk

Open-air golf carts and low-speed or under-speed vehicles operate differently than standard passenger vehicles. They may operate on public streets, private drives, parking areas, venue areas, event zones, loading areas, and other permitted routes.

Passengers voluntarily assume all risks associated with riding, including but not limited to sudden stops, turns, bumps, uneven pavement, curbs, potholes, weather, wind, rain, heat, cold, vehicle movement, nearby traffic, pedestrians, cyclists, animals, road closures, emergency vehicles, venue traffic, crowd movement, and the actions or inactions of other drivers or third parties.

2. Passenger Safety Rules

  • Remain seated while the cart is in motion.
  • Every passenger must have their own seat.
  • Safety belts must be worn and fastened at all times while riding.
  • Passengers must be able to sit upright independently with the cart's seat belt properly fastened for the entire ride.
  • No lap riders are permitted.
  • Keep arms, legs, feet, hands, hair, clothing, bags, drinks, phones, and belongings inside the cart at all times.
  • Canes, walkers, folding wheelchairs, bags, and other mobility or personal items must be stored only where the driver determines they can be safely secured.
  • Do not stand, lean out, hang off the cart, switch seats, dance, horseplay, or attempt to exit while the cart is moving.
  • Do not distract the driver or interfere with the driver's operation of the cart.
  • Follow all driver instructions immediately.
  • Passengers who refuse to follow safety rules may be denied service, removed from the ride, or have the ride ended early without refund.

3. Alcohol, Open Containers & Intoxication Policy

The Golf Cart Girl-CLE does not sell, serve, provide, furnish, or distribute alcoholic beverages. Some experiences may include stops at licensed bars, restaurants, breweries, wine bars, event venues, or other locations where guests may choose to purchase alcohol independently.

  • No passenger may consume alcohol while riding in a cart.
  • No passenger may bring, carry, hold, or possess an open alcoholic beverage on any cart.
  • No BYOB, outside alcohol, coolers with alcohol, or open containers are permitted on any cart.
  • Passengers are responsible for complying with all Ohio alcohol, open-container, public-consumption, venue, event, and outdoor refreshment area rules.
  • Alcohol purchased at a venue must remain where legally permitted and may not be brought onto the cart unless sealed and legally transportable.

The Golf Cart Girl-CLE and its drivers reserve the right to refuse boarding, delay departure, stop a ride, end a ride early, or deny further service to any passenger who appears intoxicated, carries an open alcoholic beverage, refuses to follow instructions, behaves unsafely, becomes disruptive, or creates a risk to themselves, other passengers, the driver, pedestrians, venues, property, or the public. No refund is owed when service is denied or ended because of passenger misconduct, intoxication, open-container issues, or safety concerns.

4. Driver Authority & Operational Changes

Passengers agree that the driver has full authority over cart safety, passenger conduct, route decisions, boarding, seating, timing, and whether a ride may safely continue.

The Golf Cart Girl-CLE may change routes, delay departure, modify pickup or drop-off locations, pause service, stop service, or cancel a ride because of traffic, street closures, police direction, venue rules, event restrictions, crowd conditions, weather, mechanical issues, battery limitations, unsafe passenger behavior, unsafe mobility-device storage, or any condition that The Golf Cart Girl-CLE or its driver believes may affect safety or operations.

5. Children, Minors & Passenger Seating

For safety reasons, every passenger, including every child, must have their own seat and must be able to sit upright independently with the cart's seat belt properly fastened for the entire ride.

No lap riders are permitted. Infants, toddlers, or children who cannot sit independently in their own seat with the cart's seat belt properly fastened may not ride.

The Golf Cart Girl-CLE does not provide, install, secure, inspect, or approve child safety seats or booster seats on carts. Children who are legally required to ride in a child restraint system or booster seat may not be transported unless The Golf Cart Girl-CLE determines in advance that the child can be safely and legally transported on the specific cart and route.

Children and minors must be supervised by a parent, guardian, or responsible adult at all times. The booking party is responsible for providing accurate passenger ages and for ensuring that any child passenger can be safely and legally transported.

The Golf Cart Girl-CLE may refuse transport if a child cannot be safely seated, properly belted, independently seated, or legally transported.

6. Fitness to Ride

By boarding, each passenger confirms they are physically able to ride in an open-air cart without aggravating any medical condition, injury, disability, mobility limitation, pregnancy-related concern, back issue, neck issue, balance issue, or other condition that could make riding unsafe or uncomfortable.

Passengers are responsible for deciding whether they are fit to ride. Passengers should not ride if doing so would create a risk to themselves or others.

Passengers who use wheelchairs, walkers, canes, scooters, or other mobility devices are responsible for determining whether they can safely transfer into and out of a cart seat. The Golf Cart Girl-CLE drivers may assist with stowing approved mobility equipment, but drivers do not lift, carry, physically transfer, or medically assist passengers.

7. ADA-Friendly Requests, Transfers & Mobility Devices

The Golf Cart Girl-CLE is ADA-friendly with advance notice when possible. Passengers who need accessibility assistance, mobility accommodations, additional boarding time, mobility-device storage, or route adjustments should notify The Golf Cart Girl-CLE before the ride so the team can review what is safely and reasonably available.

Guests using wheelchairs or other mobility devices must be able to transfer into a regular cart seat and ride with the cart's seat belt properly fastened. The Golf Cart Girl-CLE does not transport passengers while seated in a wheelchair, scooter, rollator, walker, or other mobility device.

When requested in advance and when safely possible, The Golf Cart Girl-CLE may store most folding manual wheelchairs by converting the rear seat into a flatbed setup and securing the chair during the ride. This ADA-friendly setup reduces available passenger seating on that cart because the rear seat area is used for mobility-device storage.

Canes, walkers, rollators, transport chairs, folding manual wheelchairs, and similar devices may be accepted only if the driver determines they can be safely loaded, positioned, secured, transported, and unloaded without creating a hazard.

Power wheelchairs, mobility scooters, oversized mobility devices, unusually heavy equipment, or devices that cannot be safely secured may not be accepted without advance review and approval. Size, weight, battery type, route conditions, pickup location, cart configuration, timing, and driver safety all matter.

Accessibility requests are handled case by case based on passenger needs, cart configuration, route conditions, timing, venue rules, device size and weight, seating needs, and safety. The Golf Cart Girl-CLE may refuse or modify transportation when a passenger or mobility device cannot be safely boarded, seated, belted, stored, secured, transported, or unloaded.

8. Personal Property

The Golf Cart Girl-CLE is not responsible for lost, stolen, dropped, forgotten, or damaged personal items, including phones, bags, wallets, purses, glasses, cameras, drinks, clothing, merchandise, mobility devices, medical equipment, or any other belongings during or after the ride.

Passengers are responsible for securing their own property before, during, and after the ride. Mobility devices and other equipment remain the passenger's responsibility even when The Golf Cart Girl-CLE assists with loading or stowing them.

9. Weather & Safety Cancellations

The Golf Cart Girl-CLE reserves the right to cancel, delay, reschedule, shorten, modify, or reroute rides at any time for safety or operational reasons, including lightning, heavy rain, high winds, unsafe road conditions, extreme temperatures, poor visibility, vehicle issues, traffic, closures, or event conditions.

When The Golf Cart Girl-CLE cancels a ride because of weather or safety conditions, refunds, credits, or rescheduling options may be offered based on the booking type, timing, and circumstances.

10. Refusal of Service

The Golf Cart Girl-CLE may refuse service, deny boarding, remove a passenger, or end a ride early when a passenger violates these rules, refuses driver instructions, appears intoxicated, possesses an open alcoholic beverage, behaves aggressively or disruptively, threatens safety, damages property, harasses others, or creates a risk to the driver, passengers, pedestrians, venues, vehicles, or the public.

The Golf Cart Girl-CLE may also refuse transport when any passenger, including a child, cannot be safely seated, properly belted, independently seated, transferred into a cart seat when needed, or legally transported.

The Golf Cart Girl-CLE may refuse or modify transport when a wheelchair, scooter, walker, rollator, stroller, bag, medical device, mobility device, or other equipment cannot be safely loaded, stored, secured, transported, or unloaded.

No refund is owed when service is denied or ended because of passenger misconduct, intoxication, open-container issues, unsafe behavior, refusal to follow safety rules, inability to safely or legally transport a passenger, or inability to safely transport a mobility device or other equipment.

11. Waiver of Claims & Release of Liability

To the fullest extent permitted by law, passengers waive, release, and agree not to bring claims against The Golf Cart Girl-CLE, its owners, members, managers, employees, drivers, contractors, affiliates, partners, venues, and representatives for injuries, damages, losses, claims, costs, or expenses arising out of or connected to their ride, except where caused by The Golf Cart Girl-CLE's gross negligence, reckless conduct, willful misconduct, or conduct that cannot legally be waived under applicable law.

This waiver includes claims related to ordinary negligence, vehicle movement, route conditions, passenger behavior, child seating, passenger seating, seat belt use, third-party conduct, traffic, weather, falls, slips, boarding, exiting, transferring into or out of a cart seat, storing or securing mobility devices, personal property, delays, changed routes, canceled rides, denied boarding, or operational changes.

12. Indemnification

Passengers agree to be responsible for any damage, loss, claim, fine, penalty, cleaning cost, repair cost, injury, or expense caused by their own conduct, unsafe behavior, violation of law, open-container violation, intoxication, damage to the cart, damage to property, inaccurate passenger or child seating information, inaccurate mobility-device information, unsafe mobility-device handling, or failure to follow driver instructions.

13. Booking Party Responsibility

The person who books or pays for a ride is responsible for sharing these safety rules and waiver terms with all members of their group. By booking on behalf of a group, the booking party confirms they are authorized to provide ride details and agrees to help ensure the group follows all safety, alcohol, child seating, passenger seating, accessibility, mobility-device, and passenger conduct rules.

The booking party is responsible for giving The Golf Cart Girl-CLE accurate information about passenger count, seating needs, child riders, accessibility requests, mobility devices, pickup details, and any condition that may affect safe boarding, seating, storage, routing, timing, or transportation.
